My Experience: How I Lost My Case After Giving Yearly Tenant 1 Month Quit Notice
My Experience: How I Lost My Case After Giving Yearly Tenant 1 Month Quit Notice Instead of 6 Months (Asaba) Landlords, learn from my mistake. Last year for Asaba, I had yearly tenant wey no pay for 8 months. I vex, I give am 1 month quit notice make he comot.
We reach Customary Court, magistrate throway my case! Why? Yearly Tenant = 6 Months Quit Notice (by law) After 6 months expire = 7 Days Recovery Notice I gave 1 month instead of 6 months = wrong notice = case dead.
I lost 8 months rent + N40k lawyer fee for nothing.
What I did after: I went to Ministry of Justice Asaba, collect correct formats: - Yearly Tenant: 6 Months Notice to Quit - Half-Yearly: 3 Months - Monthly: 1 Month - After notice expire: 7 Days Notice of Recovery Now my second case for same house, I used correct 6 months + 7 days, tenant comot in 14 days without lawyer.
Lessons: 1.
Never give yearly tenant 1 month notice - na 6 months. 2. If you give wrong months, tribunal go throway case. 3. Always serve 7 Days Recovery after quit notice expire. Make una no make my mistake. Yearly = 6 months! Ask me questions below, I go answer.
