However, prosecution counsel, C. V. Ononye, objected to the application, arguing that the prosecution had not been sufficiently informed and had not been given adequate notice to respond. The court, while taking into consideration the health condition of the defendant, who had reportedly spent three weeks in the Intensive Care Unit of Chukwuemeka Odumegwu Ojukwu University Teaching Hospital, ordered that he be returned to the hospital.
